WA just passed a law making it illegal to smoke (anything) or drink (anything) or eat anything while driving.
But the citizens are going to put it on the ballet and get it removed.

If one is driving, their concentration should be on the road, not drinking, smoking, eating, etc..

In Texas, starting Sept 1, 2017, texting and driving is illegal.

I understand the texting, its already illegal here. However I disagree that smoking a cigarette or drinking a coffee on the way to work is consistent with distracted driving.

Any distraction while driving is dangerous in my opinion.. While the car is stationary, sure you can drink coffee and smoke a cigarette but while the vehicle is in motion, hands should be on the steering wheel and eyes should be on the road in front.. :)

Below are some results from studies conducted on Cigarette use and driving.. The evidence is very clear..

The study found that on average, drivers who were smoking were even more distracted than people who used a cell phone. Cigarette smokers averaged 12.0 seconds of distraction (equitable to traveling 525 feet without looking at the road), while cell phone users averaged 10.6 seconds of distraction (traveling 492 feet).

Further, in their training manual for Commercial Drivers License drivers, the Federal Motor Carrier Safety Administration strongly discourages smoking while driving. The FMCSA conducted its own 5 year study into the dangers of smoking while driving a truck and found that smoking was a source of distraction in 0.9 percent of distraction-related crashes. This equates to approximately 12,780 crashes over the five year period examined."

In regards to drinking,

"...In a different study of 1000 drivers by ExxonMobil Corp, it was discovered that over 70% of drivers eat while driving – and 83% drink beverages. While eating, a driver’s reaction speed is lowered by 44%. While drinking, it drops 22%. While drinking, a driver is 18% more likely to experience bas control over the lane."

That may be true but it is still a failure to prioritize....this is a state that refuses to do anything about 18 wheel truck drivers driving without a CDL or people driving on a suspended license without insurance, who they come across due to them causing accidents. A state that wants to pass a law that would not allow people to be jailed due to driving without a license because it would be cruel, they need their car to go to work. Laughable as they rarely jail anyone. A state that only finds it to be a felony on the 5th DUI.

Yes, I agree it is all about prioritization. Politicians who create the laws are often times influenced by various outside factors and unfortunately often times those outside factors go against the betterment of society and as a result mankind suffers. It is indeed a paradox for sure..

For the time being, try not to drive and be distracted at the same time not only for your safety but for others as well. :)

Wow! That is crazy.
I agree that people should be fined for being distracted, but hey, if they are not insured or licensed then they should not be driving. Take a bus.
